The 2006 Control of Asbestos Regulations (CAR2006) sets out the Duty to Manage Asbestos. This imposes a duty of care upon the duty holder to manage asbestos within non-domestic properties, and the communal areas of domestic dwellings, ie blocks of flats.

The regulations also specify that if you are carrying out any major refurbishment or demolition, an asbestos survey should be undertaken prior to these works taking place, this is also supported by the Construction Design Management Regulations 2007 (CDM2007). In this instance it would be necessary to carry out a Refurbishment and Demolition Survey (previously known as a Type 3 Survey).
